Resolution No. ____, 2012 

            Board Member __________________ presented the following Resolution and moved its adoption. 

             WHEREAS, CG Roxane, LLC wishes to access certain pre-designated portions of the Waterworks Property where it believes spring water resources exist for possible development of a spring water bottling plant in the Town of Johnstown or Town of Ephratah; and  

            WHEREAS, the City of Johnstown Water Board has oversight authority over the management of the Waterworks Property’s municipal water supply; and 

            WHEREAS, the Water Board passed a Resolution on February 13, 2012 approving a Right of Entry and Inspection Agreement, copy of which is annexed hereto as Schedule ‘A’, with CG Roxane, LLC to develop a spring water bottling plant. 

            NOW, THEREFORE, BE IT

            RESOLVED, that the Mayor be and she is hereby authorized and directed to execute a Right of Entry and Inspection Agreement, with CG Roxane, LLC to develop a spring water bottling plant
