The Common Council recently amended the City of Johnstown Code of Ordinances, Chapter 10, Section 10-1401, entitled Bonfires and Outdoor Rubbish Fires. This amendment would allow outdoor burning in the City of Johnstown. Anyone wishing to have a recreational fire must comply with the provisions of said Ordinance. Provisions include, but are not limited, to the following:

Permits

    1. Any person who wishes to have a recreational fire in a portable fireplace or similar device must obtain a permit prior to such a fire. The permit shall contain the name and address of the location where the portable fireplace or similar device is to be used. Such permit is not transferable to any other person or location.
       
    1. The permit specified in paragraph A shall require an annual fee of fifteen ($15.00) dollars to be paid to and collected by the Fire Department. A copy of this ordinance shall be provided along with the permit.
       
    1. No recreational fire shall be started or allowed to continue unless the permit can be produced and shown to anyone who requests to see the permit.
       
    1. Any recreational fire, portable fireplace or similar device not in compliance with all the terms of this ordinance may, in addition to any other penalties, result in the permanent revocation of the permit.
       
    1. Permits for recreational fires shall be issued only to the property owner or to a tenant, provided that the tenant supplies the Fire Department with a letter of approval for the permit signed by the property owner.

Any person who violates any provision of this ordinance shall, upon conviction thereof, be guilty of a violation and shall be subject to a fine not to exceed $250.00 or imprisonment for a term not to exceed 15 (fifteen) days or both.
