A meeting of the Johnstown Planning Board was held on May 6, 2008 at 4:00p.m., in the Council Chambers, City Hall.
PRESENT:
ABSENT: Others present were Kay B. Cole, Liaison and Mayor Sarah J. Slingerland. A motion to bring the meeting to order was made by Mrs. White and seconded by Mrs. Johnson. Motion carried. The minutes of the April 1, 2008 meeting were approved with a motion from Mrs. White and seconded by Mrs. Johnson. Motion carried. FAGE – is seeking final approval to add an additional four silos. This project does not require County approval. Mr. Kortz made a motion to name the Johnstown Planning Board as lead agency and to issue a negative declaration in the SEQR process. Mrs. Johnson seconded the motion. Motion carried. Mrs. White made a motion to approve the application as submitted and to give FAGE a one-year conceptual approval. Motion was seconded by Ms. Knowlton. Motion carried. PEARL LEATHER – a notice was sent to the Gloversville City Clerk because the project is adjacent to the municipal boundary. This project is not subject to County referral. DEC was the only response to the SEQR. They agree with the City of Johnstown Planning Board acting as lead agency. Mr. Kortz made a motion to declare the Board as lead agency and issue a negative declaration. Mrs. White seconded the motion. A motion to approve the application and give a one-year conceptual approval was made by Mr. Kortz and seconded by Mrs. Johnson. Motion passed with three ayes and one member abstaining (Knowlton). DOUG’S POOL & HOT TUB – Doug Hancock would like to put up a 15 foot swimming pool with a sign, on property at 340 N. Comrie Ave., next to Udderly Delicious, to advertise his pool business. The pool would be filled with sand and have a safety net. His business is not located on this property but is run from his residence in the Town of Johnstown. The sign would be 4’X8’. Mrs. White and Ms. Knowlton expressed concern about safety around the swimming pool. Mrs. White is also concerned with sight distance for cars coming out of Bloomingdale Ave. The Board discussed signs and whether or not a free standing sign could be erected on property when the business is not located on that property. The swimming pool could be considered a structure. It is a display rather than a sign. Chairman Smith said that other displays along 30A have the businesses right there. Mr. Kortz said the concept of advertising on a piece of land that you do not own or where your business is not established is, to him, the important point. If the Planning Board allows the practice of advertising with a sign or display we have to be concerned about where else we may allow it. This is a precedence setting decision if we allow this. The Re-Zoning Committee will be addressing the sign ordinance and billboards at their next meeting. The final process in adopting the new zoning is a couple of years away. Based upon all the merits of what the Board discussed, Mr. Kortz made a motion to deny the application. Mrs. White seconded the motion. Motion carried.
